17.24.010 Purpose.

The R-3 district is a residential zone classification which permits a higher density of population than the R-2 district. This district provides for the establishment of single-family, two-family, multiple-family dwellings, and small lot single-family dwellings, while insuring a high degree of protection from hazards, objectionable influences, traffic and building congestion, and lack of light, air and privacy. Certain essential and compatible public service facilities and institutions are permitted in this district. (Ord. 944 § 7 (part), 1996).

17.24.020 Permitted uses.

The following uses are permitted in an R-3 district:
A. All uses allowed in the R-1 and R-2 zones plus multiple-family units;
B. Single-family residences including manufactured homes and their customary uses on lots less than the minimum lot area set forth in this zone, subject to site plan review and approval by the planning commission;
C. Churches, community clubhouses, noncommercial art galleries, libraries, museums, schools and parks;
D. Family child care homes, subject to the conditions set forth in Sections 17.36.070 and 17.36.080 of this title;
E. Child day care centers operated in a school, church or community clubhouse. (Ord. 1166 § 7, 2005: Ord. 1037 § 9, 2000; Ord. 944 § 7 (part), 1996).

17.24.030 Secondary uses.

The following secondary uses are permitted in an R-3 district: any secondary use permitted in an R-2 district as per Section 17.22.030. (Ord. 944 § 7 (part), 1996).

17.24.040 Prohibited uses.

The following uses are prohibited in the R-3 district: all uses not expressly permitted are prohibited. (Ord. 944 § 7 (part), 1996).

17.24.050 Minimum requirements.

The minimum lot area, lot dimensions, yard requirements, court dimensions and distances between buildings in an R-3 district are as follows:
A. Single-family dwellings and manufactured homes: lot area of not less than five thousand square feet, with a minimum lot width of fifty feet and minimum lot depth of one hundred feet. Manufactured homes shall comply with KMC Section 17.20.060(G);
B. Two-family dwelling: lot area of not less than six thousand five hundred square feet, with a minimum lot width of sixty-five feet and minimum lot depth of one hundred feet;
C. Multiple-family dwelling: lot area of not less than six thousand five hundred square feet for the first two dwelling units, plus one thousand square feet for each of the next four dwelling units, plus five hundred square feet for each additional dwelling unit in excess of six. Minimum lot dimensions: lot width of sixty-five feet, lot depth of one hundred feet;
D. Front Yard. Each lot shall have a front yard containing a minimum depth of twenty-five feet from any structure to the front property line, except in the case of new subdivision and development applications received after July 1, 2004 which shall have a minimum depth of twenty feet from any structure to the front property line;
E. Side Yards. For a single-family dwelling the side yards shall be a minimum of five feet in width. For two-family and multifamily dwellings, each side shall be a minimum of eight feet in width. However, for any corner lot, the side yard adjoining the street shall not be less than fifteen feet in width;
F. Rear yard: fifteen feet;
G. Small Lot--Site-Plan Review. Any building proposed to be located on lots with less than the minimum lot area and lot dimensions set forth in subsections A through E of this section must first submit a site development plan to be reviewed and approved by the city public works director. Small lots shall comply to the standards and application processes as set forth in Chapter 17.23 of this title;
H. All garages constructed as accessory buildings shall be of design, height and construction in harmony with the principal dwelling or structure and shall be primarily for the purpose of storing the automobiles of the tenants of the principal structure to which the garage is accessory. 17.24.060 Percentage of lot coverage.

On any lot in the R-3 district, all buildings, including accessory buildings and structures, but excluding patios with open lattice or similar type roof construction, shall cover not more than sixty percent of the area of such lot. (Ord. 944 § 7 (part), 1996).

17.24.070 Maximum height of buildings.

No building in an R-3 district shall exceed four stories, and no building shall have exterior walls that exceed forty feet in height as measured from the ground elevation. An accessory building’s exterior walls shall not be greater than twelve feet in height or measure sixteen feet to the peak of the roof as measured from the ground elevation. 17.24.080 Off-street parking.

Off-street parking shall be provided in the R-3 district in accordance with the requirements of Chapter 17.44 of this title. (Ord. 944 § 7 (part), 1996).
